Assault / Domestic Assault Charges in Washington
Assault is punishable by up to one year in jail and / or a $5000 fine. If an assault involves family members or people who live together, it can be charged as domestic violence. In addition to assault other charges can be upgraded with a domestic violence characterization..Charges such as Malicious Mischief, Harassment and Violation of a No Contact Order can have increased penalties when they involve a family member or people who live together. A domestic violence charge can result in additional penalties, including loss of the right to bear arms and mandatory attendance of a 12-month domestic violence treatment program.
Domestic assault convictions are typically more difficult to remove from your record than a general assault conviction. Whereas an assault conviction may typically be removed after three years, a domestic assault conviction will often take five years for removal (if removal is allowed at all).
If you are an immigrant who has not yet received full citizenship, a domestic violence or assault conviction can place you in jeopardy of deportation.
