Resisting Arrest

What is Resisting Arrest?

According to RCW §9A.76.040, a person is guilty of resisting arrest if he intentionally prevents or attempts to prevent a peace officer from lawfully arresting him.

It is common for resisting arrest charges to be compounded with another charge such as DUI, theft, possession of marijuana, etc.

Penalties for Resisting Arrest in Washington:

Resisting arrest is a misdemeanor, which RCW §9A.20.021 defines as punishable by up to ninety days in jail, a maximum fine of $1,000, or both.

Defending a Resisting Arrest Charge:

There may be a number of ways to defend a resisting arrest charge. The charge requires the offender to act intentionally. Therefore, you might argue that you did not act intentionally. An arrest is a complicated and high stress situation. Your actions may have been interpreted by law enforcement as resistance when, in fact, they were not meant as such. Your defense strategy is crucial, and the help of a skilled criminal defense attorney is strongly advised.
