What is Drug Trafficking?

Drug trafficking is the manufacturing, possession or delivery of drugs in large quantities. Therefore, a drug trafficking charge depends heavily upon the weight of the controlled substance in question, and not merely upon the possession or act of moving the controlled substance.

Penalties for Drug Trafficking:

Drug trafficking penalties may be imposed at the state level or at the federal level. In either case, the penalties depend upon the circumstances surrounding the charge and upon factors such as the type of drug, the weight, the past criminal history of the offender, or whether the offense involved conspiracy, laundering, or racketeering.

Washington State Drug Trafficking Penalties:

According to RCW §69.50.401, the manufacturing, possession, or delivery of any form of a controlled substance included in the statute’s Schedule I or II and classified as a narcotic, flunitrazepam, or amphetamine is considered a class B felony and upon conviction may be imprisoned for a maximum of ten years, fined, or both. The fine may be determined as follows:

  1. A maximum of $25,000 if the crime involved less than two kilograms of the drug; or
  2. A maximum of $100,000 for the first two kilograms and a maximum of $50 for each gram in excess of two kilograms.
