Driving under the influence is USUALLY a gross misdemeanor. However, pursuant to RCW 46.61.502 it can be considered a class C felony (with a maximum sentence of eight years in prison) if:
- You have four or more prior offenses within ten years; OR
- You have been previously convicted of:
- Vehicular homicide while under the influence;
- Vehicular assault while under the influence; OR
- An out of state offense comparable to vehicular homicide or vehicular assault
